Terms of service
These terms of service (the “Terms”) govern your access to and use of Endless - the AI-powered creative workspace at endless.app, together with its related sites, apps, and APIs (the “Service”), operated by Endless Machine Corp., a Delaware corporation with registered address at 8 The Green STE 13642, Dover, DE 19901, United States (“Endless”, “we”, “us”).
By creating an account, accessing, or using the Service you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.
Please read these Terms alongside our Privacy policy and Subprocessors list, which are incorporated here by reference.
1. Eligibility and accounts
You must be at least 16 years old (or the age of digital consent in your country) to use the Service. Accounts and authentication are managed through our identity provider; you are responsible for keeping your credentials secure and for all activity under your account.
The Service is organized around workspaces. A workspace owner or admin controls membership, roles, and billing for that workspace, and may remove members or reassign roles. Members share access to the workspace’s content according to the permissions set by admins.
2. Acceptable use
You agree not to use the Service to:
- Break the law, infringe intellectual property, or violate the rights of others.
- Generate or distribute content that is unlawful, sexually exploitative of minors, harassing, or that promotes violence or discrimination.
- Attempt to reverse-engineer, disrupt, overload, or gain unauthorized access to the Service or its infrastructure.
- Circumvent usage limits, credit metering, or access controls, or resell the Service without our written permission.
- Upload malware, or submit content you do not have the rights to use with AI generation tools.
We may suspend or terminate access that violates these rules, and may remove content that we reasonably believe breaches them or applicable law.
3. Your content
“Your content” means the prompts, files, images, audio, video, transcripts, and other materials you upload to or create with the Service. As between you and Endless, you retain all rights you hold in your content.
You grant Endless a worldwide, non-exclusive license to host, store, process, transmit, and display your content solely to operate, secure, and improve the Service and to provide it to you and your workspace. We do not sell your content, and we do not use it to train our own models. Where your content is processed by the third-party AI providers listed on our Subprocessors page to generate output you request, we choose providers with privacy-protective terms and enable no-training or zero-retention options where available.
You are responsible for your content and for having the rights necessary to submit it, including any rights required to use it with the AI models we route to on your behalf.
4. AI-generated output
The Service uses third-party AI models to generate images, video, audio, text, and analysis (“output”). Subject to these Terms and your payment of applicable fees, we assign to you whatever rights we hold in the output you generate, so you can use it for your projects.
AI output can be inaccurate, may resemble output produced for other users, and may not be eligible for copyright protection in every jurisdiction. You are responsible for reviewing output before relying on or publishing it. The Service is not a substitute for professional advice.
5. Credits, plans, and billing
Paid features are metered in credits and billed through our payments processor. Generation consumes credits based on the model and operation used; plans, seat pricing, and spending limits are described at checkout and in your workspace billing settings.
Subscriptions renew automatically for the billing period you select until cancelled. Except where required by law, fees and consumed credits are non-refundable. We may change prices on a going-forward basis with reasonable notice; changes do not affect the period you have already paid for.
You are responsible for taxes associated with your use of the Service, except taxes based on our net income.
6. Third-party services
The Service depends on third-party providers for hosting, authentication, payments, storage, email, AI inference, and analytics. These providers act as our subprocessors and are listed on our Subprocessors page. Your use of connected third-party services may also be subject to their own terms.
7. Our intellectual property
The Service, including its software, design, and the Endless name and logos, is owned by Endless and protected by intellectual-property laws. These Terms grant you a limited, non-transferable, revocable right to use the Service; they do not transfer any ownership in the Service to you.
8. Suspension and termination
You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if necessary to protect the Service or other users.
On account deletion we apply a soft-delete for a limited period to protect against accidental loss and to meet legal obligations, after which personal data is deleted or irreversibly anonymized as described in our Privacy policy. Some records may be retained where the law requires.
9. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate or fit for your purpose.
10. Limitation of liability
To the maximum extent permitted by law, Endless will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or relating to the Service is limited to the amounts you paid us for the Service in the twelve months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.
11. Changes to these Terms
We may update these Terms from time to time. If we make material changes we will provide reasonable notice, for example by posting the updated Terms with a new effective date or by notifying you in the Service. Your continued use after the changes take effect constitutes acceptance.
12. Governing law and contact
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, and subject to any mandatory protections available to you as a consumer in your country of residence. The state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except where mandatory law gives you the right to bring proceedings in the courts of your country of residence.
